These Terms of Service ("Terms") govern your access to and use of the services provided by Luviio ("Luviio", "we", "us", or "our"). By accessing our website, subscribing to any plan, submitting any form, or engaging our services, you agree to be legally bound by these Terms.
If you do not agree, you must not use our services.
1. Services
Luviio provides subscription-based digital services, including but not limited to website development, mobile application development, IT support, website content updates, SEO implementation, technical consulting, and promotional service packages.
The exact deliverables and service limits are determined by your subscribed plan or custom proposal. Third-party costs such as domain registration, hosting fees, paid plugins, SaaS subscriptions, and payment gateway charges are excluded unless expressly stated.
2. Subscription Plans and Billing
All subscription plans are billed on a recurring monthly basis unless otherwise agreed in writing.
By subscribing, you authorize Luviio to automatically charge your selected payment method each billing cycle until cancellation.
- Fees are billed in Malaysian Ringgit (MYR)
- Payments are due in advance
- Late or failed payments may result in service suspension
- All fees are non-refundable once billed, except where required by law
3. Free Trials and Promotions
Any free trial or promotional pricing is subject to eligibility requirements. Luviio may suspend or revoke promotional access if verification fails, eligibility criteria are not met, or misuse is suspected.
4. Cancellation and Termination
Subscriptions are billed month-to-month and may be cancelled at any time. Cancellation takes effect at the end of the current billing cycle. No prorated refunds will be issued.
Luviio reserves the right to suspend or terminate services immediately if payment is overdue, if abusive or illegal activity occurs, or if the Client breaches these Terms.
5. Client Responsibilities
The Client agrees to provide lawful and accurate content, maintain secure credentials, cooperate during service delivery, and comply with all applicable laws. Delays caused by missing materials or non-responsiveness may extend delivery timelines.
6. Scope of Work and Revisions
Services are limited to the deliverables included in the subscribed plan or written proposal. Requests outside the agreed scope may require additional fees, revised timelines, or plan upgrades.
7. Intellectual Property
Upon full payment, the Client owns the final deliverables specifically created for the Client. Luviio retains ownership of proprietary systems, templates, reusable frameworks, internal tools, methodologies, and licensed third-party assets.
8. Third-Party Services
Luviio may integrate third-party services including hosting providers, analytics platforms, APIs, and payment gateways. Luviio is not liable for interruptions, failures, or damages caused by third-party systems.
9. Warranties and Disclaimers
Services are provided on an "as is" and "as available" basis. Luviio does not guarantee uninterrupted operation, search rankings, traffic increases, sales results, or business outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, Luviio's total liability shall not exceed the total amount paid by the Client in the three months preceding the event giving rise to the claim.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall first be resolved through good-faith negotiation before mediation or arbitration.
